1. Acceptance of Terms

By downloading, installing, or using the Should I Fish Today (S.I.F.T.) mobile application or website ("Service"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, please do not use our Service.

2. Description of Service

Should I Fish Today (S.I.F.T.) is a fishing technology application that provides:

• Real-time river and weather data analysis
• AI-powered fishing recommendations and scoring
• Catch logging and fishing data tracking
• Location-based fishing insights and conditions
• Premium subscription features including detailed analytics

The Service uses various data sources including weather services, USGS river gauges, and user-generated content to provide fishing recommendations and insights.

3. User Accounts and Registration

To access certain features of the Service, you must create an account. You agree to:

• Provide accurate and complete information during registration
• Maintain the security of your account credentials
• Notify us immediately of any unauthorized use of your account
• Be responsible for all activities that occur under your account
• Be at least 13 years of age to use the Service

4. Subscriptions and Payments

4.1 Subscription Tiers

S.I.F.T. offers two tiers:

• Free Tier: Access to basic river conditions and limited catch logging
• Premium Subscription: Full access to all features, including unlimited catch logging, detailed analytics, and advanced insights

4.2 Auto-Renewable Subscriptions

Premium subscriptions are auto-renewable and include:

• Monthly: $6.99/month, billed monthly
• Annual: $59.99/year, billed annually (save 29%)

4.3 Payment Terms

• Payment will be charged to your Apple ID account or Google Play account at confirmation of purchase
• Subscription automatically renews unless canceled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel subscriptions in your device's account settings
• No refunds for partial subscription periods

4.4 Free Trial (if applicable)

If we offer a free trial, you will be charged when the trial ends unless you cancel before the trial period expires. Trial eligibility is determined by us and may be limited to new users only.

4.5 Price Changes

We reserve the right to change subscription prices. You will be notified of any price changes in advance, and changes will apply to subsequent billing periods.

5. User Content and Conduct

5.1 Your Content

When you submit content (catch logs, photos, notes), you:

• Retain ownership of your content
• Grant us a license to use, display, and process your content to provide the Service
• Represent that you have the right to share the content
• Are responsible for your content

5.2 Prohibited Conduct

You may not:

• Use the Service for any illegal purpose
• Violate any fishing regulations or laws
• Share false or misleading information
• Attempt to reverse engineer or hack the Service
• Use automated tools to access the Service
• Share your account credentials with others
• Interfere with the operation of the Service

6. Data Accuracy and Disclaimer

S.I.F.T. provides fishing recommendations based on real-time data from third-party sources (USGS, weather services, etc.). While we strive for accuracy:

• Data may be delayed, incomplete, or inaccurate
• Fishing recommendations are AI-generated estimates, not guarantees
• You are responsible for verifying conditions and safety before fishing
• We are not liable for decisions made based on our recommendations

ALWAYS check local regulations, weather conditions, and water safety before fishing. S.I.F.T. is a tool to assist decision-making, not a substitute for personal judgment and safety precautions.

7. Intellectual Property

The Service, including its design, features, algorithms, and content (excluding user-generated content), is owned by S.I.F.T. and protected by copyright, trademark, and other intellectual property laws.

You may not:

• Copy, modify, or distribute our content without permission
• Use our trademarks or branding without authorization
• Create derivative works based on our Service

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, S.I.F.T. SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, or consequential damages
• Loss of profits, data, or business opportunities
• Injuries or accidents occurring while fishing
• Inaccurate data or recommendations
• Service interruptions or outages
• Third-party data source failures

Our total liability to you for any claims arising from use of the Service shall not exceed the amount you paid for the Service in the past 12 months.

9. Indemnification

You agree to indemnify and hold harmless S.I.F.T., its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service, your content, or your violation of these Terms.

10. Privacy

Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy to understand our data practices.

11. Termination

We reserve the right to suspend or terminate your account at any time for:

• Violation of these Terms
• Fraudulent or illegal activity
• Abuse of the Service or other users
• Non-payment of subscription fees

You may terminate your account at any time through app settings or by contacting us. Upon termination, your right to use the Service will immediately cease, though certain provisions (like liability limitations) will survive termination.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notification. Your continued use of the Service after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms are governed by the laws of the United States and the State of New York, without regard to conflict of law principles. Any disputes shall be resolved in the courts of New York.
